CSent Terms of Use

These Terms of Use govern your access to and use of CSent. Please read them carefully before creating an account or using the service.

In these Terms, "CSent", "we", "us" and "our" refer to Talarge Technologies Ltd.

2. Accepting these Terms

By creating a CSent account, you agree to these Terms of Use.

Our Privacy Policy explains how we process personal information. Acknowledging or reading the Privacy Policy is not the same as consenting to every form of data processing.

Where separate consent or permission is required for particular processing or functionality, it may be requested separately.

If we make a material change to these Terms, we may ask existing users to agree to the new version before continuing to use affected parts of CSent where appropriate.

3. Who can use CSent

You must be 18 years of age or older to create or use a CSent account.

By creating an account, you confirm that you are at least 18.

You must provide information that is reasonably accurate and must not impersonate another person or create an account for another person without proper authority.

Unless CSent expressly states otherwise, an age declaration is not independent age or identity verification.

4. What CSent provides

CSent provides tools intended to help adults explore relationship topics, communicate, understand each other better, make and communicate choices, and retain information they deliberately choose to keep.

Features may include:

  • Relationship Hub content, including Discover, Play, Talk & Understand and Support;
  • Saved items and Plans;
  • Connections, private choices and mutual outcomes;
  • Connection Chat;
  • Our Space;
  • Our Space Messages;
  • Check In;
  • Us;
  • Boundaries;
  • general Messages and message requests;
  • Community;
  • Private Records, files and notes;
  • notifications;
  • educational and safety resources; and
  • account and privacy controls.

Some functionality may be identified as planned, experimental or Coming soon and may not yet be available. Features may change as CSent develops.

5. CSent and consent between people

CSent is intended to support communication. It does not replace communication between people.

A CSent record does not determine whether legal consent exists.

A person's previous choice, message, confirmation, acknowledgement or participation in CSent does not mean that they have permanently or continuously consented to an activity.

People may change their minds. Consent may be withdrawn.

CSent must never be used to pressure someone to participate in or continue an activity.

The existence or absence of a CSent record should not be treated as automatically proving that consent did or did not exist at a particular moment.

6. Data-processing consent is different

Permission for Talarge Technologies Ltd to process personal information is separate from consent between people.

Accepting these Terms, acknowledging the Privacy Policy or giving CSent permission to process particular information does not constitute sexual consent or consent to any other interpersonal activity.

Similarly, using CSent's Withdraw Consent functionality within a Connection concerns the participant's interpersonal choice and is separate from withdrawing permission for Talarge Technologies Ltd to process personal information.

7. Connections

A Connection is a communication feature that allows participants to make and communicate choices through CSent.

Creating, joining or participating in a Connection does not itself establish legal consent to any activity.

A mutual choice means only that CSent identified the relevant choices as mutual according to the feature's operation at that time. It does not mean that consent continues indefinitely or that circumstances outside CSent satisfy any legal requirement.

Each participant is responsible for making their own choices.

You must not:

  • make selections on behalf of another participant;
  • force another person to create or join a Connection;
  • pressure someone to confirm choices;
  • use threats or intimidation to obtain participation;
  • access another person's account to make choices for them; or
  • deliberately interfere with another participant's ability to change or withdraw their choices.

Private choices remain subject to the visibility rules of the relevant feature. Only information intended to become mutual or shared through the feature should be treated as shared Connection information.

8. Changing or withdrawing choices

A participant may change their choices using the functionality CSent provides.

Where a Connection allows withdrawal of consent, a participant may use the Withdraw Consent function.

Users should not rely solely on CSent to communicate an urgent change of mind where direct communication is reasonably possible.

CSent does not guarantee that another person will immediately see a notification or update.

If immediate safety is at risk, users should seek appropriate emergency or specialist assistance rather than relying on CSent.

9. Ending a Connection

Ending a Connection is separate from withdrawing consent.

Ending records the normal completion of the Connection. Withdrawal records that a participant used CSent's withdrawal functionality.

Neither event should be interpreted beyond what the relevant CSent record actually shows.

10. Our Space

Our Space is a persistent private area that two CSent users may choose to establish together.

Creating, accepting, joining, using or remaining in an Our Space does not:

  • establish consent to any activity;
  • mean that either person agrees with the other's choices or views;
  • establish any particular legal or relationship status; or
  • give either person unrestricted access to information belonging to the other.

Different Our Space features have different privacy and sharing rules. Leaving or ending an Our Space does not itself determine the status of a relationship outside CSent.

11. Check In

Check In is intended to support private reflection and conversation between members of an Our Space.

It is not a clinical, psychological, compatibility, safety or relationship assessment.

Shared summaries are limited interpretations generated from the relevant responses and should not be treated as a complete account of how either person feels.

Private safety responses are not designed to be disclosed to the other participant through the Check In feature. CSent cannot guarantee that a person has disclosed everything they feel or that a relationship is safe.

12. Us

Us is intended to help people learn more about each other through shared activities.

Answers are private from the other participant while the relevant experience is in progress and are revealed according to the feature's mutual-reveal design after both participants complete it.

Matches and differences shown by Us are conversation prompts. They are not compatibility scores, predictions or assessments of relationship quality.

13. Boundaries

Boundaries helps users record and, where they choose, communicate selected preferences or boundaries.

A boundary belongs to the person who records it. Sharing a boundary communicates what that person has chosen to share at that time.

Selecting I understand means only that the recipient has acknowledged seeing the current shared information. It does not mean agreement, acceptance, consent, permission, contractual commitment or confirmation that a boundary has been or will be respected.

A person may change what they have recorded or stop sharing it using the functionality CSent provides.

A recorded indication that someone is comfortable with something must not be treated as continuing consent to future activity.

You must not pressure another person to change, share or remove a boundary.

14. Messaging and message requests

CSent may provide Connection Chat, Our Space Messages and general Messages within My CSent.

General messaging between users is available only after the applicable message-request process has been accepted.

Acceptance of a message request permits use of the relevant messaging functionality. It does not create a Connection, Our Space, relationship or consent to any activity.

You must not use any CSent messaging feature to harass, threaten, pressure, manipulate or repeatedly contact another person contrary to the controls CSent provides.

15. Relationship Hub, Saved and Plans

Relationship Hub content, including Discover, Play, Talk & Understand and Support, is provided for general information, reflection, conversation and entertainment.

It is not a substitute for professional medical, mental-health, relationship, legal or other specialist advice.

Saving or planning an idea does not mean CSent guarantees that an activity is suitable, safe, available or appropriate for every person or circumstance. You remain responsible for considering your own circumstances.

Features labelled Coming soon or planned are not currently provided merely because they appear in the interface.

16. Records

CSent may retain records created through your use of the service.

These records are intended to help users retain information processed through CSent.

CSent records:

  • are not a guarantee that an event occurred exactly as described;
  • do not establish guilt or innocence;
  • do not independently establish whether legal consent existed;
  • do not replace evidence gathered by competent authorities;
  • are not legal advice; and
  • are not guaranteed to be admissible or given any particular weight in legal proceedings.

Where CSent records system-generated dates, times, integrity information or events, those features relate to the operation of CSent and should not be interpreted as independent verification of matters occurring outside the service.

17. Private Records

CSent may allow you to privately record an incident, experience or other matter. This functionality is intended as a personal documentation tool.

You are responsible for deciding what information you choose to record and should avoid deliberately including unnecessary personal information about another person.

Creating a Private Record in CSent:

  • does not make a police report;
  • does not automatically notify an authority;
  • does not start an investigation;
  • does not mean CSent has verified the contents; and
  • does not require you to take any further action.

If you want to report something to the police, obtain medical assistance, obtain legal advice or contact a specialist support service, you must contact the relevant organisation directly. CSent may provide links to external resources for convenience, but those organisations operate independently from CSent.

18. Uploaded files and material

Where CSent allows you to save files or other material, you are responsible for the material you choose to upload.

You must not knowingly upload material that:

  • you have no lawful right to possess or store;
  • unlawfully violates another person's privacy;
  • contains malicious software;
  • is uploaded for harassment, threats or intimidation;
  • is unlawful to possess; or
  • is otherwise being used to abuse the CSent service.

Technical integrity features provided by CSent relate to the digital material stored through the service. They do not prove that the events depicted or described in a file occurred.

19. Community

If you use CSent Community, you must comply with the CSent Community Guidelines.

You must not use Community to:

  • threaten or harass another person;
  • publish another person's private information without an appropriate basis;
  • impersonate another person;
  • attempt to identify or expose an anonymous Community participant;
  • post unlawful intimate or private material;
  • use hate speech;
  • spam or manipulate discussions;
  • use Community to coerce another person; or
  • otherwise misuse the service.

CSent may moderate or remove Community content and may restrict access where reasonably necessary to enforce these Terms, the Community Guidelines, protect users, comply with law or maintain the service.

Anonymous Community posting means your identity is not displayed to other Community users through the normal interface. It does not mean Talarge Technologies Ltd has no record of the account associated with the content.

20. Account security and Privacy Lock

You are responsible for taking reasonable steps to keep your account and devices secure.

Privacy Lock, where available, is an additional interface-level privacy control. It does not replace device security, account security or safe handling of your login credentials.

You must not:

  • share your login credentials in a way that enables another person to operate your account;
  • deliberately access another person's account without authority;
  • bypass or attempt to bypass CSent security controls;
  • exploit vulnerabilities;
  • interfere with the service; or
  • use automated means to attack, overload or improperly access CSent.

Please contact support@csent.app if you believe your account has been compromised.

21. Prohibited use

You must not use CSent:

  • for an unlawful purpose;
  • to coerce or manipulate another person;
  • to fabricate or deliberately falsify records;
  • to impersonate another person;
  • to harass, threaten or abuse someone;
  • to unlawfully disclose private information;
  • to interfere with another user's account or records;
  • to attempt to circumvent access restrictions;
  • to distribute malware or malicious content;
  • to exploit or attack CSent's systems; or
  • in a way that materially interferes with other users' use of the service.

You must not present CSent as having verified something that CSent has not verified.

22. Safety and emergencies

CSent is not an emergency service.

Do not rely on CSent, its messaging, notifications or Help functionality to obtain emergency assistance.

If you or another person is in immediate danger, contact the emergency service appropriate to the country or region you are in.

Health, sexual-health, wellbeing, relationship, legal and support information made available through CSent is intended as general information or signposting unless expressly stated otherwise.

Some external resources may be country-specific. It is your responsibility to use an appropriate local service where necessary.

CSent information is not a substitute for professional medical, legal, mental-health or other specialist advice.

23. Notifications

CSent may provide in-app, email or push notifications depending on available functionality and your settings.

Delivery may depend on internet access, your device, browser, operating system, notification permissions and third-party infrastructure.

We therefore cannot guarantee that a notification will arrive immediately or at all. Do not rely on notifications as the only way of communicating something urgent.

24. External services and links

CSent may link to third-party websites or services, including health and support resources.

We do not control those external services and are not responsible for their content, availability, security or privacy practices.

A link does not necessarily mean that we endorse every statement or service provided by the external organisation.

25. Intellectual property

CSent and its software, branding, designs, text and other materials are owned by or licensed to Talarge Technologies Ltd except where otherwise stated.

These Terms give you a limited, personal, non-exclusive and revocable right to use CSent in accordance with these Terms. They do not transfer ownership of CSent or its intellectual property to you.

You retain rights you have in content that you create or provide. You give us the permissions reasonably necessary to host, process, transmit and display your content solely as required to operate CSent, provide the features you request, maintain security and comply with applicable law.

26. Privacy

Our Privacy Policy explains how Talarge Technologies Ltd processes personal information.

Our Cookies & Device Storage Notice explains the storage and access technologies used by CSent.

You should read these documents alongside these Terms.

27. Availability and changes

We aim to keep CSent available and reliable, but we do not guarantee uninterrupted or error-free availability.

We may need to maintain or update the service, correct defects, improve security, modify features, respond to legal requirements or discontinue functionality.

Where reasonably possible, we will seek to avoid unnecessary disruption. We may change CSent as the product develops, provided we continue to comply with our legal obligations.

28. Suspension and termination

We may restrict, suspend or terminate access to CSent where reasonably necessary, including where:

  • you materially breach these Terms;
  • your use presents a security risk;
  • your account is being used unlawfully;
  • your activity threatens or seriously harms other users;
  • we are required to do so by law; or
  • continued access creates a material risk to CSent or its users.

Where appropriate and reasonably possible, we may provide notice or an opportunity to address the issue. Nothing in this section prevents us taking immediate action where reasonably necessary for security, safety or legal compliance.

29. Closing your account

You may request account deletion through the available CSent account/privacy controls.

Because some CSent records involve interactions between more than one person, deleting your account does not necessarily mean every shared record will automatically disappear from another participant's account.

Our Privacy Policy explains how private and shared information is considered when an account is deleted.

30. Our responsibility to you

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

In particular, nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded.

CSent is intended as a communication, relationship, educational and personal-record tool.

To the extent permitted by law, Talarge Technologies Ltd is not responsible for decisions made independently by users, the conduct of other users, or events occurring outside the CSent service merely because CSent was used before, during or after an interaction.

We do not guarantee that use of CSent will prevent disputes, misunderstandings, misconduct, harm, false statements or criminal behaviour.

Nothing in these Terms affects any statutory or mandatory rights you have as a consumer that cannot lawfully be excluded or restricted.

31. Your responsibility

You are responsible for:

  • using CSent lawfully;
  • making your own choices;
  • respecting other people's choices and boundaries;
  • keeping your account and devices secure;
  • ensuring information you deliberately provide is not knowingly false or misleading;
  • considering the privacy of others when creating records or messages; and
  • seeking appropriate professional or emergency assistance when required.

32. Changes to these Terms

We may update these Terms where reasonably necessary because of changes to CSent, applicable law, security requirements, our business or operating arrangements, or the services we provide.

The current version and effective date will be displayed with the Terms.

Where a change materially affects your rights or obligations, we will take reasonable steps to bring it to your attention and obtain renewed agreement where required.

33. Governing law and consumer rights

These Terms are governed by the laws of England and Wales.

If you are a consumer outside England and Wales, you may also have rights under mandatory laws that apply where you live. Nothing in these Terms excludes or restricts consumer protections or other rights that cannot lawfully be excluded or restricted.

34. If part of these Terms is invalid

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

35. No waiver

If we do not immediately enforce a provision of these Terms, that does not mean we have waived our right to enforce it later.
